President of the Law Society of Kenya Nelson Havi has recounted how Dr. Alexander Muteshi physically assaulted him earlier today while serving him a Court Order over Dr. Miguna Miguna’s deportation.

In a tweet on Wednesday, Havi claims Director-General, State Department of Interior and Citizen Services, Alexander Muteshi Imbenzi said High Court Order directing that Miguna Miguna be given a temporary travel document by the Kenyan embassy in Berlin, Germany for travel to Kenyan will not be obeyed.

”For him, Miguna Miguna is not a Kenyan citizen and lost Kenyan citizenship upon acquiring a Canadian Passport. Alexander Muteshi Imbenzi claims that Miguna Miguna must re-apply for Kenyan citizenship. He physically assaulted me as I served the Order upon him this morning,” Nelson Havi tweeted.

On Monday in Nairobi, Lady Justice Hedwig Ong’udi ruled Dr. Miguna Miguna should present himself to the Kenyan High Commission in Canada or in an embassy wherever he is and apply for emergency travel documents to Kenya within 72 hours.

“Nobody has stopped him from traveling to Kenya, but let him obtain the required Kenyan traveling documents within 72 hours after which he should be allowed to board the next available flight,” Justice Ongudi ruled.

The Lady justice ruled that Miguna, just like any other Kenyan must obey immigration rules to get required traveling documents and should not insist on being allowed to travel using his national identity card.

”Upon obtaining the emergency pass from any Kenyan high commission or embassy, he should be allowed to travel on any airline and only use his identity card for clearance at the immigration desk to enter the country.”
